Facts
Before marriage, Marcellus Murdock and Paula Vaughan executed an antenuptial agreement providing that each relinquished claims to the other's property, except that if Paula was living with Marcellus as his wife at his death she would receive the homestead, household goods, automobile, and a child's share of his estate. The couple married, later physically separated in 1964, but no divorce or separate maintenance proceeding was ever filed, Paula remained in the family home, and Marcellus continued to support her. Marcellus later executed a will making Paula's benefits conditional on her living with him as his wife at death, and he also signed an unattested paper labeled a codicil stating that because Paula was not then living with him, those bequests were intended to be void. After his death, Paula sought a larger statutory share, while other parties disputed whether the antenuptial agreement was valid and whether Paula satisfied its 'living with' condition.
Issue

Rule
Antenuptial agreements are generally favored and enforced when fairly made; a contract is against public policy only when its terms encourage separation or divorce as a source of pecuniary advantage. When such an agreement chiefly governs property rights at death and becomes executed by the death of a party, references to separation do not invalidate it; and a spouse may be considered 'living with' the other at death absent an actual, deliberate, and complete severance of marital relations or legal dissolution, especially where support continues.
