Terms of Service & Privacy Policy

1. Acceptance of Terms

By clicking "Accept and Continue" (or a similar check-box or button indicating acceptance), or by otherwise accessing or using KwikCourt LLC ("Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service & Privacy Policy ("Terms").

You represent and warrant that you have the legal capacity and authority to enter into a binding agreement. If you do not agree to these Terms, you must not access or use the Service.

2. Nature of the Service — Educational Use Only (Not Legal Advice)

KWIKCOURT LLC IS AN EDUCATIONAL AND ACADEMIC STUDY AIDE ONLY.

  • No Legal Advice. Content provided through the Service, including AI-generated feedback, explanations, grading, rule summaries, analytics, or recommendations, does not constitute legal advice and should not be relied upon as such.
  • No Attorney–Client Relationship. Use of the Service does not create an attorney–client relationship between you and KwikCourt LLC, its founders, operators, or affiliates.
  • No Guarantees. KwikCourt LLC makes no representations or warranties regarding academic performance, examination results, bar passage, or professional competency. You use the Service at your own risk.
  • Jurisdictional Variability. Laws vary by jurisdiction and change over time. Content may be incomplete, outdated, or inaccurate for your particular jurisdiction or circumstances.

3. User Content; Ownership and License Grant

3.1 User Content Defined

"User Content" includes all data, text, essays, written responses, submissions, inputs, metadata, profile information, usage data, analytics, and other materials that you submit, upload, generate, or make available through the Service, including Short Answer responses and free-text inputs.

3.2 Ownership

You retain any ownership rights you may have in your User Content, subject to the license granted below.

3.3 Broad License to KwikCourt LLC (Including Commercialization and Sale)

By submitting User Content, you irrevocably grant KwikCourt LLC a perpetual, worldwide, royalty-free, fully paid-up, transferable, and sublicensable license to:

  • use, host, store, copy, reproduce, modify, adapt, translate, analyze, index, and create derivative works from such User Content;
  • distribute, publicly perform, publicly display, and otherwise exploit such User Content;
  • commercialize such User Content in any manner, including by selling, licensing, sublicensing, or otherwise transferring it to third parties, whether alone or combined with other data;
  • use such User Content for research, analytics, artificial intelligence and machine learning training, product development, benchmarking, marketing, and other commercial or business purposes.

This license survives termination of your account and applies regardless of whether such User Content is anonymized, pseudonymized, aggregated, or identifiable, to the maximum extent permitted by law.

4. Data Collection and Use

4.1 Data We Collect

We may collect and process information including, without limitation:

  • Identifiers (such as name, email address, law school, and account credentials)
  • Educational and usage data (scores, streaks, performance metrics, analytics)
  • Text submissions and written responses
  • Device, log, and interaction data
  • Any other information you voluntarily provide through the Service

4.2 Use of Data

KwikCourt LLC may use User Content and other collected data for any lawful purpose, including but not limited to:

  • Operating, maintaining, and improving the Service
  • Developing, training, and refining artificial intelligence systems
  • Creating individual or aggregated analytics and benchmarks
  • Research, internal analysis, and product development
  • Commercial monetization, including data licensing, transfer, or resale
  • Compliance with legal obligations
  • Corporate transactions, including mergers, acquisitions, or asset sales

5. Data Sharing and Sale

KwikCourt LLC may share, transfer, license, or sell User Content and other collected data to third parties, including but not limited to:

  • Educational institutions or publishers
  • Employers or recruiters
  • Artificial intelligence, data analytics, or research organizations
  • Commercial partners
  • Acquirers, successors, or assigns

Such data may be shared in anonymized, aggregated, pseudonymized, or identifiable form, at KwikCourt LLC's discretion, subject to applicable law. You acknowledge and agree that such sharing or sale of data is a core component of KwikCourt's business model.

6. Consent to Commercial Use of Content

By accepting these Terms, you expressly consent to KwikCourt LLC's collection, use, processing, and commercialization of your User Content, including the sale or licensing of such content to third parties, as described in these Terms.

Where required by law, you may exercise applicable opt-out rights by contacting KwikCourt LLC. Any such opt-out will not apply retroactively to data already processed, transferred, licensed, or sold.

7. User Responsibilities and Restrictions

You agree not to:

  • Share account credentials or permit unauthorized access to your account
  • Attempt to reverse engineer, scrape, copy, or extract the Service, its databases, or source code
  • Submit confidential, privileged, or real client information through the Service
  • Use the Service for unlawful, deceptive, or misleading purposes

KwikCourt LLC reserves the right to suspend or terminate accounts for violations of these Terms, at its sole discretion.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KWIKCOURT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF ACADEMIC OPPORTUNITY, FAILURE TO PASS EXAMS, DATA LOSS, OR REPUTATIONAL HARM.

KWIKCOURT LLC'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO KWIKCOURT LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 IF YOU ARE A FREE USER.

10. Termination

KwikCourt LLC may suspend or terminate your access to the Service at any time, with or without notice, for any lawful reason. Sections relating to licenses, data use, liability limitations, and disclaimers survive termination.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict-of-laws principles.

12. Changes to These Terms

KwikCourt LLC may modify these Terms at any time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
