Terms of Service & Privacy Policy

1. Acceptance of Terms
By clicking "Accept and Continue" (or a similar check-box or button indicating acceptance), or by otherwise accessing or using KwikCourt LLC ("Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service & Privacy Policy ("Terms").
You represent and warrant that you have the legal capacity and authority to enter into a binding agreement. If you do not agree to these Terms, you must not access or use the Service.
2. Eligibility and Age
The Service is intended for users who are at least 18 years old and able to form a legally binding contract. By using the Service, you represent that you meet these requirements. The Service is not directed to children, and KwikCourt LLC does not knowingly collect personal information from anyone under 18. If we learn we have collected such information, we will delete it. If you believe a minor has provided us personal information, contact admin@kwikcourt.com.
3. Nature of the Service — Educational Use Only (Not Legal Advice)
KWIKCOURT LLC IS AN EDUCATIONAL AND ACADEMIC STUDY AIDE ONLY.
- No Legal Advice. Content provided through the Service, including AI-generated feedback, explanations, grading, rule summaries, analytics, or recommendations, does not constitute legal advice and should not be relied upon as such.
- No Attorney–Client Relationship. Use of the Service does not create an attorney–client relationship between you and KwikCourt LLC, its founders, operators, or affiliates.
- No Guarantees. KwikCourt LLC makes no representations or warranties regarding academic performance, examination results, bar passage, or professional competency. You use the Service at your own risk.
- Jurisdictional Variability. Laws vary by jurisdiction and change over time. Content may be incomplete, outdated, or inaccurate for your particular jurisdiction or circumstances.
4. Subscriptions, Billing, and Cancellation
4.1 Free and Premium Tiers. The Service offers a free tier (no payment required) with limited daily usage, and a paid "Premium" subscription that removes those limits. Features in each tier are described on the Service and may change over time.
4.2 Price and Billing. Premium is an auto-renewing subscription offered in three billing options: $12.99 per month, $29.99 per 3 months, or $99.99 per 12 months (each plus any applicable taxes). Payments are processed by our third-party payment processor, Stripe; KwikCourt LLC does not store your full payment-card details. By subscribing, you authorize KwikCourt LLC and Stripe to charge your payment method the applicable fee.
4.3 Automatic Renewal — Please Read. YOUR PREMIUM SUBSCRIPTION AUTOMATICALLY RENEWS EACH MONTH. Unless you cancel before the end of the current billing period, your payment method will be charged the then-current monthly fee at the start of each new billing period, automatically and without further notice, until you cancel. By subscribing you affirmatively consent to this recurring charge.
4.4 Cancellation. You may cancel at any time through the billing portal in your account (Profile), without contacting us. Cancellation stops future renewals; your Premium access continues until the end of the billing period you have already paid for, after which your account reverts to the free tier.
4.5 No Refunds. Except where required by applicable law, all payments are final and non-refundable, including for partial billing periods, unused time, or periods of non-use.
4.6 Price Changes. KwikCourt LLC may change subscription prices or tier features. We will provide notice of a price increase before it takes effect, and the new price applies to your next billing period. Continued subscription after the change constitutes acceptance of the new price.
4.7 Failed Payments. If a charge fails, we (via Stripe) may retry and may suspend or downgrade your Premium access until payment succeeds.
5. User Content; Ownership and License Grant
5.1 User Content Defined
"User Content" includes all data, text, essays, written responses, submissions, inputs, metadata, profile information, usage data, analytics, and other materials that you submit, upload, generate, or make available through the Service, including Short Answer responses and free-text inputs.
5.2 Ownership
You retain any ownership rights you may have in your User Content, subject to the license granted below.
5.3 License to KwikCourt LLC
By submitting User Content, you grant KwikCourt LLC a worldwide, royalty-free, transferable, and sublicensable license to use, host, store, copy, modify, adapt, translate, analyze, index, and create derivative works from your User Content in order to operate, provide, and improve the Service, and to develop, train, and improve artificial-intelligence and machine-learning systems. KwikCourt LLC may sell, license, or otherwise share User Content or data derived from it with third parties only in de-identified, anonymized, or aggregated form (for example, anonymized essay text or aggregate performance metrics) that does not identify you. This license survives termination of your account.
6. KwikCourt Intellectual Property
The Service, including all software, compilations, case briefs, questions, explanations, text, graphics, logos, and the "KwikCourt" name and marks (collectively, the "KwikCourt Materials"), is owned by KwikCourt LLC or its licensors and is protected by intellectual-property laws. Underlying case-law text originates from public sources; our selection, compilation, summaries, questions, and explanations are our proprietary work. Except for the limited right to use the Service under these Terms, KwikCourt LLC grants you no rights in the KwikCourt Materials. You may not copy, reproduce, distribute, publicly display, create derivative works from, or otherwise exploit any KwikCourt Materials without our prior written consent.
7. Copyright Concerns
If you believe content on the Service infringes your copyright, please contact us at admin@kwikcourt.com and we will review and respond.
8. User Responsibilities and Restrictions
You agree not to:
- Share account credentials or permit unauthorized access to your account
- Attempt to reverse engineer, scrape, copy, or extract the Service, its databases, or source code
- Submit confidential, privileged, or real client information through the Service
- Use the Service for unlawful, deceptive, or misleading purposes
KwikCourt LLC reserves the right to suspend or terminate accounts for violations of these Terms, at its sole discretion.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, KWIKCOURT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF ACADEMIC OPPORTUNITY, FAILURE TO PASS EXAMS, DATA LOSS, OR REPUTATIONAL HARM.
KWIKCOURT LLC'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO KWIKCOURT LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 IF YOU ARE A FREE USER.
11. Indemnification
You agree to indemnify, defend, and hold harmless KwikCourt LLC and its officers, members, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms or applicable law; or (d) your violation of any third-party right.
12. Termination
KwikCourt LLC may suspend or terminate your access to the Service at any time, with or without notice, for any lawful reason. Sections relating to licenses, data use, liability limitations, and disclaimers survive termination.
13. Information We Collect
We collect and may collect the following categories of information:
- Account information you provide (email, name, law school, and settings).
- Learning and usage activity, including the questions you view and answer, the specific answer choices you select, scores, streaks, XP, progress, bookmarks, saved bundles, and how you interact with the Service.
- Written responses you submit, such as short-answer text (see Section 5).
- Device and technical data, such as browser type, device identifiers, IP address, and log data, collected automatically as you use the Service.
- Payment information, collected and processed by Stripe; we do not store full card details.
- Advertising and analytics data, including information collected through cookies and similar technologies to measure usage and, on the free tier, to deliver advertising.
We may add categories of information as the Service evolves and will update this policy accordingly.
14. How We Use Information
KwikCourt LLC may use the information it collects for any lawful purpose, including to: operate, maintain, and improve the Service; develop, train, and refine artificial-intelligence systems; create individual and aggregated analytics and benchmarks; conduct research and product development; deliver and measure advertising (on the free tier); communicate with you; comply with legal obligations; and carry out corporate transactions such as mergers, acquisitions, or asset sales.
15. Cookies, Analytics, and Advertising
KwikCourt uses cookies, local storage, and similar technologies for essential functions (such as keeping you signed in), to analyze usage, and — on the free tier — to deliver and measure advertising. Some of these technologies may be provided by third-party analytics and advertising partners that may collect information about your activity across services. You can control cookies through your browser settings, and where required we will provide a consent or opt-out mechanism.
We currently use the Reddit conversion pixel (provided by Reddit, Inc.) on our websites and app. It sets a cookie ("_rdt_uuid") and shares limited information with Reddit — such as the pages you visit, the fact that an account was created, your IP address, and device information — so we can measure the effectiveness of our advertising on Reddit. This may be considered "sharing" for cross-context behavioral advertising under some state privacy laws; you may opt out as described in Section 18, and you can also limit ad personalization in your Reddit account's privacy settings.
16. How We Share Information; De-Identified Data
KwikCourt LLC does not sell your identifiable personal information (such as your name or email). KwikCourt LLC may share, license, or sell de-identified, anonymized, and/or aggregated data — including anonymized essay/short-answer text and aggregate performance metrics — to research, analytics, educational, and commercial partners. Before sharing, KwikCourt LLC de-identifies or aggregates such data so it cannot reasonably identify you, maintains that de-identification, does not attempt to re-identify it, and contractually prohibits recipients from re-identifying it.
KwikCourt LLC may also disclose identifiable personal information only: (a) to service providers that operate the Service on our behalf (see Section 19) under use-limiting contracts; (b) to analytics and advertising partners in connection with the advertising described in Section 15; and (c) to an acquirer or successor in a merger, financing, or sale of assets.
17. Consent
By accepting these Terms, you consent to KwikCourt LLC's collection, use, and processing of your data as described here, and to the sharing, licensing, or sale of de-identified, anonymized, or aggregated data as described in Section 16. You may exercise the privacy rights and choices described in Section 18 by contacting admin@kwikcourt.com.
18. Your Privacy Rights and Choices
Depending on where you live (for example, California, Virginia, Colorado, Connecticut, or Texas), you may have some or all of these rights regarding your personal information. Subject to applicable law and identity verification, KwikCourt LLC honors:
- Access / Know — the categories and specific pieces of personal information we've collected, and how we use and disclose it.
- Deletion — deletion of personal information we collected from you, subject to legal exceptions.
- Correction — correction of inaccurate personal information.
- Portability — a copy of your personal information in a portable format.
- Opt out of sale/sharing — you may opt out of the "sale" or "sharing" of your personal information, including sharing for targeted or cross-context advertising. Where required by law, we honor recognized opt-out signals such as Global Privacy Control.
- Non-discrimination — we will not deny service, change pricing, or degrade your experience for exercising these rights.
How to exercise. Email admin@kwikcourt.com. We may need to verify your identity before acting, and you may use an authorized agent. We will respond within the time required by applicable law (generally within 45 days, extendable where permitted). Once information is de-identified or aggregated, it can no longer be linked to you and cannot be individually accessed, corrected, or deleted.
19. Service Providers
We rely on a limited set of vendors who process data only to provide services to us: Google Firebase (authentication and database), Stripe (payments), and Render (hosting). If we enable error monitoring, Sentry may process technical error data. Reddit, Inc. processes advertising-measurement data collected by the Reddit conversion pixel (see Section 15). If and when we serve advertising, additional analytics and advertising partners may process data as described in Sections 15–16. We do not sell personal information to these providers.
20. Data Retention
We retain your account information and learning activity while your account is active and as needed to provide the Service, and thereafter as required to comply with legal obligations, resolve disputes, and enforce our agreements. You may request deletion as described in Section 18.
21. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict-of-laws principles.
The Service is intended for users in the United States. We do not target it to the European Union or United Kingdom, and if you access it from outside the United States you are responsible for compliance with applicable local laws.
22. Changes to These Terms
KwikCourt LLC may modify these Terms from time to time. If we make material changes, we will provide reasonable notice — for example, by posting the updated Terms with a new "Last Updated" date and, where appropriate, notifying you in the app or by email. Changes are effective when posted or on any later stated effective date. Your continued use of the Service after changes take effect constitutes acceptance; if you do not agree, you must stop using the Service.
23. Miscellaneous
(a) Entire Agreement. These Terms are the entire agreement between you and KwikCourt LLC regarding the Service and supersede prior agreements on that subject. (b) Severability. If any provision is held unenforceable, the remaining provisions stay in effect and the unenforceable provision will be enforced to the maximum extent permitted. (c) No Waiver. Our failure to enforce a provision is not a waiver. (d) Assignment. You may not assign these Terms; KwikCourt LLC may assign them, including in a merger, acquisition, financing, or sale of assets. (e) Force Majeure. KwikCourt LLC is not liable for delays or failures caused by events beyond its reasonable control. (f) Contact. Questions about these Terms may be sent to admin@kwikcourt.com.
